bring a gun into the country. >> a lesser person would have pleaded guilty. >> they chained him to a bed and reportedly threatened his life. but this marine stayed strong. and now time finally to come home. i'm harris faulkner in tonight for shepard smith. and we begin tonight with president obama's new move to reshape his cabinet. at the white house today he announced massachusetts senator john kerry as his pick for the next secretary of state. >> john has played a central role in every major foreign policy debate for nearly 30 years. as we turn the page on a decade of war, he understands that we have got to it harness all elements of american power and ensure that they are working together. >> the president then saying senator kerry's entire life has prepared him for this role. the senator has spent decades on the foreign relations committee and he is currently the chairman of that. he is also a former presidential candidate as you know.

and a decorated vietnam veteran who was critical of the war effort when he returned to the u.s. senator kerry's nomination came after susan rice came under recently she was thought to be a frontrunner for the job until her comments on the attacks u.s. consulate in libya triggered strong criticism of her. you may have noticed the current secretary's absence from today's announcement. the president saying secretary clinton still recovering from concussion. wendell goler with the news. with the burden of proofy road once first alert forecast for susan rice now gone, senator kerry expected to easily win confirmation from his senate colleagues. >> well, harris, as the president put it, kerry won't need much on-the-job training. he has been chairman of the foreign relations committee for the past six years and was president president obama's emissary to pakistan, egypt and sudan. and in the senate which is a pretty close nit group.

form senator obama says not block nomination. >> he has earned the trust of his senate colleagues, democrats and republicans. i think it's fair to say that few individuals know as many presidents and prime ministers or grasp our foreign policies as firmly as john kerry. this makes him a perfect choice to guide american diplomacy in the years ahead. >> in fact, it's terry's open foreign relations committee that will conduct the confirmation hearings. harris? >> harris: i mentioned moments ago that ambassador susan rice withdrew her name from contention because of the controversy over benghazi. does this end the debate over that. >> republicans frankly say. no they still have questions about what senator clinton and the president knew about security at the consulate and about the attack and when did they know it. but they made clear in a news conference today that a a susan rice confirmation hearing would have been bitter because of her insistence a week after the attack that it grew out of the protest of

anti-islam movie. >> i just did not believe that our country is going to be well-served by people who i, quite frankly, didn't trust. and susan rice, let's just get to the heart of the matter, i don't question her character or prism. i just thought that he was very eager to tell a story that did not make a lot of sense. >> lawmakers say they still want to hear from secretary of state clinton before voting on the kerry confirmation but it's democrats on the committee who will schedule the confirmation date. harris? >> harris: wendell goler outside the white house tonight. thank you very much. we are getting new information tonight about a possible motive for the attack on the consulate in benghazi and fox news has learned there are more suspects in custody than we realized. details coming up inside the fox report. the only thing that stops a bad guy with a gun is is a good guy with a gun. those words from the head of the national rifle association today. he spoke exactly one week after the massacre in new town, connecticut. a school shooting that killed

26 children and adults at sandy hook elementary. today nra boss wane lapierre blamed violence on the media bloody movies and violent video games. he blamed lawmakers for making schools an easy target for the monsters living among us. >> politicians pass laws for gun free school zones. they issue press releases bragging about them. they post signs advertising them appeared in doing so, they tell every insane killer in america that schools are the safest place to inflict maximum mayhem with minimum risk. >> harris: lapierre then called on congress to put an armed officer in every school by next month when kids go back after the holidays. protesters disrupted his comments at least twice today. one of them claiming the nra

has blood on its hands. james rosen live in washington tonight. james, there was an overarching point today that lapierre was making. what was it? >> well, he cited the presence of armed and trained security officers, harris at banks, courthouses, power plants, defense installations and also the presence of firearms being carried by the secret service in and capitol police to protect the president and all of our lawmakers. >> what if when adam lanza started shooting his way into sandy hook elementary school last friday he had been confronted by qualified armed security? will you at least admit it's possible that 26 little kids, that 26 innocent lives might have been spared that day? >> the nra also retained asa

hutchison the former u.s. attorney, congressman and u.s. security official to develop a model school safety plan focused on issues of design and access control and training for students and educators alike that the group said could be tailored by any school to suit its needs. harris? >> harris: if people were anywhere near their computers or tv's today they saul duling news conferences all over the place with people on different sides of gun control debate appearing. but then they didn't seem to be anywhere near a compromise. >> no, harris. and president obama released a video message today vowing to fight nor new gun laws early next year. the contours of this debate are already taking shape as leading democrats press for a renewed assault weapons ban and for new limits on semiautomatic ammuniti magazines. a leading senate democrat says she favors schools being allowed to have armed guards if they so choose but then she then cited the columbine massacre. >> in fact, there were two

>> harris: president obama is about to leave for hawaii after giving congressional leaders orders. that's a live look at joint air base andrews as we are expected to see any minute now as they take off hawaii are for hawaii. god only knows how they will avoid the fiscal cliff that was after he had to cancel a vote on his own plan because his own members would not support it president obama says he just told speaker boehner and senate majority leader harry reid exactly what to do, and he says they can get it done. before automatic spending cuts and tax hikes kick in on new year's day. ed henry live at the white house. ed? so what's the president's new plan? >> well, harris, the president said he came into the briefing room and said maybe is he a hopeless optimist but is he a new slim down three point plan that he says can pass in 10 days. basically extend tax cuts for

98% of americans. he said both parties agree with that extend unemployment benefits for 2 million americans. those are expiring about a week after christmas. that's a big problem. and then he says come back and do spending cuts and deficit reduction in the new year. he is telling lawmakers take a few days off. relax over the holidays and maybe we'll all come together. take a listen. >> sing some christmas carols, enjoy the company of loved ones. and then i would ask every member of congress while they are back home to think about that think about the obligations we have to the people who sent us here. think about the hardship that so many americans will endure if congress does nothing at all. >> now, i can hear the helicopters warming up there on the other side of the white house from where i am on the south lawn. the president will be heading to andrew's air force base in a moment. is he going to hawaii tonight. on his way out the door told us "see you next week." which means he will be coming back after christmas before new years to try to work this out with lawmakers. he also suggested maybe they

have eggnog over the holiday. maybe he thinks that will grease the skids. >> harris: eat cookies and sing carols for the rest of us across the country. you get the accepts he is trying to calm things down. if you took a look at the markets today you might understand why. after what happened last night, ed, the house basically pulling its plan b, can anything pass at this point? mention the markets. jittery right now they had been stable in recent peeks. before christmas everybody would magically come together. that obviously has not come together. there is fear need the white house. i have talked to top aides that they think they are going to work something else. they are nervous if they don't get something done after christmas the markets will really take a hit. speaker boehner today was pretty blunt about saying after he pulled the bill last night because he didn't have enough conservatives to support him that he frankly is not sure what the way forward is take a listen. >> how we get there god only

business network. for weeks it's been reported that investors had already figured into the numbers if you will the fiscal cliff. why are we here? >> you mean at the point that we're down on the dow and down today? >> harris: yeah. >> first of all it could have been worse. when you saw the future last night what he would realized there was not going to be a deal in the house investors said it's not going to be good. they pulled back. there is still 10 days. some investors believe that will happen. priced. in big money investors already pulling out of the market. they were selling some of their stocks in anticipation what will be a tax hit for them no matter what. they were getting ready for. this you still have optimism among some investors that there could be a deal. monday is going to be a low volume day. it's a half day of trading anyway. >> harris: that's a blessing. >> that is a blessing there are still people who expect this to go right up to the last possible second. and, remember, warren buffet when people panic this is your opportunity to buy. >> harris: i do remember he said that very interesting. you are the silver lining kind of a guy that we love.

there is a silver lining in this for people with nest eggs. i know it's bark right now but there is the flip side. >> you can look at this year already. the dow suspect. year-to-date we are up almost 8%. the s&p is up almost 13%. nasdaq is up over 15%. and there are plenty of analysts you can find analyst who will say it's going to be a bad 2013. it's going to be a good 2013. the people who will get hurt worse by all of this is people who have cash savings. no interest rates. we are not getting interest on those savings. when money is cheap, stock market tends to go up. let's say we go of 00 cliff. you might see the markets sell off for a bit. that's when people will jump back. in cheap money means stocks usually go up. >> harris: adam shapiro. good to see you. happy holidays. >> happy holidays. >> harris: we are learning more suspects in libya that killed ambassador and who they're and why they have launched that massive attack on our consulate there. more about the motive. a live report coming up inside "the fox report." plus, you're waiting for

>> harris: fox news more suspects in custody. until now we had only heard about two men one in to your knowledge and one in egypt. the terror attack that killed a u.s. ambassador to libya chris stevens state department official sean smith and two former navy seals tyrone woods and glen doherty. what more do we know about these suspects. >> the head of the house intelligence committee would not identify the countries

involved citing the sensitive nature of the investigation but confirmed there are other suspects in custody and federal agents are not getting the access they want. i will say i'm concerned about the multiple suspects taken into custody by other nations who could have strong information about the perpetrators to this event. earlier this month they detained a family roomer member of the egyptian islamist jihad benghazi attack. fox has told access has been blocked. lawmakers say federal investigators know who some of the players are but not their specific roles adding the investigation ♪ where they would like it to be. across the spectrum there is more that needs to be done. yes, we are still far from having definitive picture to what degree there was any level of command and control. and who was responsible. >> fox news asked the fbi for

hawaii. they say their goodbyes we will stay on the story with the fiscal cliff, of course and let you know when it makes news again. speaker boehner also saying that he is optimistic that they can get a deal done. i'm harris faulkner in tonight for shepard smith. this is the fox report. a former u.s. marine who has been chained to his bed in a mexican prison should be freed by the end of today. that was the word. john hammar has reportedly been locked up since august in one of the prisons south of the border. a place where drug cartel run the show. mexican police reportedly arrested hammar when he crossed the border from texas with what his family says was an antique gun. mexico is very strict with firearms and the size of hammar's gun was apparently shorter than the law allows there. and for that, he was facing 15 years behind bars. steve harrigan live in our south florida newsroom with more now. steve, what do we know about hammar's impending release?

>> harris, that release could happen any minute. we have been following the twitter account of his lawyer and talking to his parents. his mother, his father, his attorney and his congresswomen all say that john hammar will be released sometime today. right now he is still in that prison. they say they are filling out the paperwork to get him out. there might be one catch. that antique rifle, that 60-year-old gun that belonged to his great grandfather, john hammar says he wants that back before he leaves. harris? >> harris: we understand he, again, was there to be on a hunting trip. so that was a family hair loom that he had planned to lose in that manner. what kind of share is he in because we have heard all sorts of things about his captivity. >> harris, this drama really started back in august, so he has been in a very tough mexican prison where a lot of drug cartel members are held and he has been stuck in there for four months. for at least part of that time he has been chained to his bed in a storage room. he has received, at the very least, threats and his family has received threats and extortion as well. keep in mind, this is exactly

the opposite of what john hammar was looking for. he is a combat veteran of iraq and afghanistan. he suffered post-traumatic stress syndrome. he was treated nine months for that syndrome. weighs looking for a relaxing surfing holiday. instead what he has gotten so far is four months in a mexican jail. a stay which could end in the next few hours, harris. >> harris: steve harrigan, thank you very much. fox weather alert now and the first major snow storm of the season making some holiday travelers feel some major stress just days away from christmas. the storm already deadly. at least 8 people in five states have died. as the system punched the upper midwest. dumping more than a foot of snow. first alert forecasters warn it's still dangerous. they say the great lakes will see more wind whipped snow today and tomorrow. so drivers there should be especially cautious. and for those wanting to fly home, airlines are telling passengers to expect delays. >> i have been here since 6:45

this morning and never left the airport. >> i have got my other two boys at the hotel with my fiancee. they are waiting on us. >> all of southwest flights are cancelled going out of the city. so we will see if i get home tonight. >> some analysts say the delays are minor so far compared to the thousands of flights airlines cancelled during super storm sandy of course that doesn't help passengers dealing with the crowds today on what experts say is the busiest travel day of the christmas season. mike tobin live at o'hare international in chicago. mike, what's the situation there? >> well, you know, harris, everybody looks at o'hare's because if it backs up here, it looks like everybody. does this look like an airport backed up. the reality is as the weather got bad yesterday there was a bunch of warm air over lake michigan and that melted the snow and turned it into a nasty cold rain. they had the flights that were delayed yesterday. they have eaten up the access that was created from that. as we look now at the big

board it's not very big. the flights that are out there have those magic words attached "on time." getting the flights out of here. we do see significant delays but they are really on either cotion. you -- coast. you can't blame the delays. >> harris: i only counted six flights they did say on time. chicago catching a break but what about the rest are of the midwest? >> in terms of weather. the rest of the midwest got clobbered. wisconsin really got clobbered in dain county where madison is, up to 20 inches of snow. iowa sees snow that rivals the records they set in 2009 or the levels they set in 2009. you have also got tens of thousands of people without power and that's because the wind gusts got up to 50 miles per hour, harris. >> that is tough. it's pretty chilly to be without electricity. we know that all too well here on the east coast. mike observe tobin thank you very much. where is all the snow going next. chief meteorologist rick reichmuth now live in the weather center. rick? >> and these storms move east. that's exactly what it's done. worst of the snow is gone.

we have had a little bit of rain today across new england. still have areas across maine. now we have cold air moving across the great lakes. we will continue to see that all weekend long. it's much colder air here. future radar looks like you continue to see the wind move across the great lakes and move more snow. that all stays towards interior sections. nothing makes its way towards the coast. all the big cities are going to be looking fine. get ready. it's going to be much colder for the rest of the weekend. but flights should be fine tomorrow. if tomorrow is your big travelsg east. >> harris: let's take a look at the west coast. they have had a nasty fall already. and they are having another wave come. >> in you have said it they have already had two big batches of storms that have brought anywhere from 10 to 20 inches of rain each of those storms. now we are dealing with another one here. can you see it the rain moving in from san francisco. big delays in the airports today in san francisco. the first storm now moving in towards the higher elevations bringing snow. take a look at this. this upper level disturbance will continue to pull a lot of

moisture in here. some areas looking at another 7 to 8 inches of rain. and the snow may be getting up to about 4 to 6 feet across the higher elevations in the mountains. harris? >> harris: apparently old man winter owns a calendar the first day and bam here it. >> thank you. many of the travelers fortunate enough to get home for christmas could find fewer gifts under the tree. delivery companies like u.p.s. and fedex reporting yesterday was the busiest shipping day of the year. just as the storm was hitting the midwest. experts say that might slow down delivery times. but the companies claim they have contingency plans for this sort of thing. so far they are not seeing any major delays due to the snow storm. felony murder. that's what they are calling an explosion in a neighborhood in indiana. the pictures incredible and details on who they arrested today and how this happened are quite unusual. police said all along it was intentional and today prosecutors say they know who blew up that house that caused damage to 90 other homes. plus, after calling on the

make our country worthy of their memory. the white house says president obama took part in the moment of silence from washington with members of his staff. rick leventhal is live for us tonight in newtown. rick? >> harris, the churches were initially asked to ring their bells 26 times and then the episcopal dies cease urged them to ring them twice more to include nancy lanza and her son saying we should pray for all souls, especially those who need it most. so the trinity episcopal church here in new town, connecticut did just that this morning and then the funerals began again. five more today. two teachers, three children remembered and laid to rest. 29-year-old rachel i davino and rachel spent 26 years. set to retire next year. grace mcdonnell and olivia ingle and dylan hockly. the special needs child found in the arms of his teacher. his brother jake released balloons in his honor.

connecticut gun store that sold nancy one of her weapons. an ar-15 was stolen from that store in east windsor connecticut on saturday, the day after the sandy hook shooting but the atf says that wasn't the only reason that they went back to that store and raided it harris? >> harris: rick leventhal live for us to newtown, connecticut a week later. thank you. state police say they have killed a man who gunned down three people in central pennsylvania today. and then opened fire at troopers. investigators say the suspect first shot a woman who been decorating a church hall for a christmas party. and then took out two men reportedly after a cob fron station at a stop sign. investigators say the gunman then fired at state troopers and smashed his pickup truck into another trooper's car. they say he got out of wrecked vehicle, firing more shots and troopers killed him. three people now facing murder charges in connection with a deadly explosion that ripped through an indiana neighborhood. it happened last month near indianapolis. you may remember these pictures. investigators say a microwave

on timer ignited natural gas inside one home. the explosion killed two neighbors and damaged or destroyed about 90 other houses. authorities say they believe the homeowner along with her boyfriend and his brother let that home fill up with natural gas through the fireplace. and then triggered the microwave to blow it up. police this morning arresting those three. there were reportedly at a casino at the time of the explosion. the fbi reports its caught one of the two convicted bank robbers whom investigators say used bed sheets to escape from a high rise jail. according to his attorney that man is likely headed back to the same facility. but this time he will probably get a special isolation unit of his very own o. the feds caught him last night in chicago where he made an initial court appearance later today. and remember officials say the two convicts tied dozens of bed sheets together and used them as rope to rappel some 20 stories down high rise building in chicago earlier this week.
